DUSHI HOLIDAYS – TERMS & CONDITIONS

Applicable to Airbnb, Booking.com, Vrbo, WeChalet, Micazu & Direct Bookings

Dushi Holidays – Curaçao

These Terms & Conditions (“Terms”) constitute a legally binding agreement between the guest (“Guest”) and Kuipers Advice & Consulting B.V., a private limited liability company incorporated under the laws of Curaçao, operating under the trade name “Dushi Holidays” (the “Host”). By confirming a reservation, the Guest acknowledges, understands, and agrees to these Terms in full.

1. Definitions

“Host” refers to Kuipers Advice & Consulting B.V. operating as Dushi Holidays.
“Guest” refers to the booking party and all occupants.
“Property” refers to the rented accommodation.

2. Contractual Relationship & Hierarchy

The rental agreement is concluded exclusively between the Guest and the Host.

Where a reservation is made through a third-party platform, the following hierarchy applies (to the extent permitted by law):

  1. Mandatory laws of Curaçao
  2. These Terms
  3. Platform-specific terms

3. Reservation & Payment

  • A reservation is confirmed only upon receipt of payment
  • The Host reserves the right to cancel unpaid or partially paid bookings
  • Obvious pricing or system errors are not binding

For direct bookings:

  • Payment deadlines are binding
  • Non-payment results in automatic cancellation without notice

4. Security Deposit & Financial Liability

  • A security deposit may be required or pre-authorized
  • The Guest is fully liable for any damage, loss, or contractual breach

Recoverable costs include (non-exhaustive):

  • Property damage
  • Missing inventory
  • Excessive cleaning
  • Utility overconsumption
  • Violations of house rules

The Guest authorizes the Host to recover such costs via:

  • booking platform mechanisms
  • direct charge where legally permitted

5. Check-in & Check-out

  • Check-in: from 15:00
  • Check-out: before 11:00

Late check-out without approval:

  • may incur additional charges
  • may include compensation for operational losses

6. Use of Property

  • Strictly residential use only
  • Only registered Guests are permitted
  • Subletting or commercial use is prohibited

Violation results in immediate termination without refund.

7. Utilities & Measured Consumption (STRICT CLAUSE)

7.1 Electricity (All Properties)

  • Included: 20 kWh per night
  • Excess usage: USD 0.55 per kWh

Measurement is based on:

  • meter readings
  • smart monitoring systems
  • reasonable calculation based on stay duration

The Host’s determination is binding unless manifestly incorrect.

7.2 Water (Apartments & Selected Villa Only)

Applicable to:

  • all apartments
  • villas explicitly designated without pool
  • Rate: USD 8.00 per m³
  • Measurement via meters or monitoring systems

7.3 Villas with Swimming Pool

  • Water consumption is included
  • No separate charge applies

7.4 Acceptance of Utility Charges

The Guest explicitly agrees that:

  • excess consumption will be charged after check-out
  • charges may be deducted from deposit or claimed via platform
  • Host calculations are contractually accepted unless clearly incorrect

Tampering with meters or systems results in:

  • immediate termination
  • full financial liability

8. House Rules & Conduct

The Guest agrees to comply with the following:

  • No parties or events without prior written approval
  • No smoking inside the property
  • No pets are allowed, except for legally recognized assistance animals in accordance with applicable laws
  • Compliance with local laws and community regulations

Additional conditions for assistance animals:

  • The Guest must inform the Host in advance
  • The animal must be properly trained and under control at all times
  • The Guest remains fully liable for any damage or additional cleaning

Violation:

  • may result in immediate termination
  • no refund
  • additional charges

9. Extra Guests & Unauthorized Access

  • Only registered Guests are permitted
  • Unauthorized persons may result in:
    • additional charges, or
    • immediate termination

10. Cleaning & Property Condition

The property must be left in reasonable condition.

Additional cleaning fees apply in case of:

  • excessive dirt
  • stains or odors (including smoke)
  • misuse of furnishings, towels, or linens

11. Maintenance, Defects & Access

  • The Guest must report issues immediately
  • The Host may access the property for:
    • inspection
    • maintenance
    • emergencies

Failure to report issues may result in additional liability.

12. Liability & Assumption of Risk

To the maximum extent permitted by law:

  • The Host is not liable for loss, theft, or damage to personal belongings
  • The Guest assumes full responsibility for safety
  • All amenities (including pools and terraces) are used at own risk

13. Internet & Technical Services

  • Provided as a convenience only
  • No guarantee of uninterrupted service
  • No liability for outages or performance issues

14. Third-Party Services

Recommendations (car rental, transfers, etc.):

  • are provided as a courtesy
  • are not the responsibility of the Host

15. Cancellations, No-Shows & Refund Policy

  • Governed by the booking platform or direct agreement
  • No refunds for:
    • no-shows
    • late arrivals
    • early departures
    • unused nights

16. Platform Enforcement

The Guest agrees that:

  • Claims may be submitted via platform systems
  • Documented evidence (photos, meter readings, logs) is sufficient

17. Chargebacks & Payment Disputes

  • The Guest agrees not to initiate chargebacks without prior contact

Unauthorized chargebacks:

  • constitute breach of contract
  • may result in legal recovery actions

Recoverable costs include:

  • original charges
  • administrative fees
  • legal and collection costs

18. Fraud & Misrepresentation

The Host reserves the right to cancel without refund if:

  • false information is provided
  • identity cannot be verified
  • fraudulent behavior is suspected

19. Right to Refuse Future Bookings

The Host reserves the unrestricted right to:

  • refuse future reservations
  • deny service

20. Security & Monitoring

  • Exterior cameras may be present
  • No surveillance in private interior spaces

The Guest consents to:

  • reasonable monitoring
  • use of footage for dispute resolution

21. Force Majeure

The Host is not liable for events beyond control, including:

  • natural disasters
  • government actions
  • utility failures
  • travel disruptions

22. Dispute Resolution & Arbitration

To the extent permitted by law:

  • Disputes shall first be addressed amicably
  • The Host may elect binding arbitration in Curaçao under international rules (UNCITRAL or ICC)
  • If arbitration is not enforceable, Curaçao courts apply

Platform dispute mechanisms may be used in parallel.

23. Currency

All amounts are stated in USD.
Local reference currency: Caribbean Guilder (XCG / Cg).

24. Severability

If any provision is deemed invalid, the remaining provisions remain fully enforceable.

25. Governing Law

These Terms are governed exclusively by the laws of Curaçao.

26. Acceptance

By confirming a reservation, the Guest confirms having read, understood, and accepted these Terms.
